Boston National Title Agency, LLC and its affiliates, (collectively referred to as “BNT”, “we” or “us”) have prepared this Privacy Policy (the “Policy”) to describe the types of personal information we obtain, how we may use the information, with whom we may share it and the choices you may have regarding our use of the information. We also describe the measures we take to safeguard the information and tell you how to contact us about our privacy practices.

This Privacy Policy applies to personal information we obtain through this website and other sites, as well as other data collection points that link to this Privacy Policy (collectively, the “Site”), and information we may obtain through other means. By using this Site, you consent to our collecting, using, and disclosing your information consistent with the privacy practices described in this Policy. We encourage you to read this Policy in full to understand our privacy practices before using this Site, submitting any personal information, or engaging in any other Interactions.

If you are a customer of Essent Title for closing services or for title insurance, this Privacy Policy does not address information you provide to obtain these services or generated as a result of these services.  Information We Collect

When you visit our Site or through interactions with you, we may collect the following categories of personal information:

  • Our affiliates, partners (such as lenders, brokers, and title or real estate agents) and vendors, including consumer reporting agencies and other third-party information sources.
  • Analytics partners who provide cookies, pixels, or similar tools on our Site.
  • Publicly available sources, such as government entities, records, and databases.

We may combine such information with information we already have about you.

How We Use the Information We Obtain

We may use the information we obtain for the following business purposes:

  • Maintaining or improving our Site, including debugging to identify and repair errors;
  • Maintaining or improving our products and services including investigating fraud, enhancing the models we use in operations, quality assurance purposes or loss mitigation;
  • Managing and mitigating risks including institutional risk controls;
  • Communicating with you, such as to respond to your inquiries or to provide you with information, periodic alerts or updates, or any other materials that you have requested from us;
  • Providing services to or receiving services from your employer, for example if you are employed by one of our customers or service providers;
  • Emailing or otherwise sending you marketing or other promotional offers and information about BNT’s or others’ products or services that may be of interest to you and administering promotions which our customers or consumers elect to participate in.
  • Protecting the security and integrity of the Site or otherwise protecting BNT’s rights or property, your health and safety, or the health and safety of others;
  • Complying with our legal obligations, responding to court or government regulator requests for information, or enforcing our legal rights;
  • Researching and modeling related to our business;
  • Operating, evaluating and improving our business (including developing new products and services; managing our communications; determining the effectiveness of our sales, analyzing and enhancing our products, services and Site; and performing accounting, auditing, billing, reconciliation and collection activities);
  • Performing data analyses and other processing (including market and consumer research, trend analysis, financial analysis, anonymization, encryption and tokenization of personal information);
  • Complying with and enforce applicable legal requirements, relevant industry standards and our policies;
  • As otherwise necessary or appropriate in connection with our business; and
  • Fulfilling any other purpose for which you provide the information as we may otherwise disclose at the time of collection.

Sensitive personal information is only used for the following purposes:

  • To resist malicious, deceptive, fraudulent, or illegal actions directed at BNT. For example, BNT may use sensitive personal information to detect fraud or potential identity theft.
  • To provide our services. For example, BNT may use sensitive personal information as part of underwriting or providing title insurance, to verify customer information, or to create, maintain or service accounts.
  • To verify or maintain the quality or safety of the services that we offer.
  • For other purposes that do not involve inferring characteristics about individuals, such as for tax purposes.

In addition, we may use information collected online through cookies, web beacons and other automated means for purposes such as (i) customizing our users’ visits to our Site, (ii) delivering content (including advertising) tailored to our users’ interests and the manner in which our users browse our Site, and (iii) managing our business. We also use this information to help diagnose technical and service problems, administer our Site, and identify users of our Site. We use clickstream data to determine how much time users spend on web pages of our Site, how users navigate through our Site, and how we may tailor our Site to better meet the needs of our users.

We also may use the information we obtain about you in other ways for which we provide specific notice at the time of collection.

BNT does not process sensitive personal information for the purpose of inferring characteristics about individuals.

BNT may retain personal information after it is no longer needed to perform the service requested by the consumer and from time-to-time temporarily access it to improve the models used in our operations.

Information We Share

We may share personal information about you as described in this Privacy Policy or, if you are an insurance or title services customer, as described in the Privacy Notice you received when you became our customer. We share personal information with third parties who perform services on our behalf. These third parties are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or to comply with legal requirements.

We may disclose information about you to the following categories of third parties:

  • Among our various businesses and affiliated companies;
  • To our authorized service providers who perform services on your behalf;
  • To law enforcement, government agencies, courts, or other third parties to protect ourselves, our employees, or others, to investigate fraud, or as required by law, such as to comply with a subpoena or similar legal process;
  • To third parties in the event BNT is involved in a merger, acquisition, or sale of all or a portion of its assets, or in the unlikely event of bankruptcy;
  • To an actuarial or research organization for the purpose of conducting actuarial or research studies;
  • When we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity; or
  • To any other third party with your prior consent.

We reserve the right to transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution, or liquidation).

Third-Party Information Collection

We may collect certain information by automated means, such as cookies and web beacons. The information we obtain in this manner may include IP address, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken on our site, and dates and times of website visits. A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon,” also known as an Internet tag, pixel tag or clear GIF, is a tiny graphic image that may be used on our Site. Through these automated collection methods, we obtain “clickstream data,” which is a log of content on which a visitor clicks while browsing a website. As the visitor clicks through the website, a record of the action may be collected and stored. Your browser may allow you to control the use of cookies, but these browser controls might not apply to all technologies. If you reject cookies, you may still use our Site, but your ability to use some features or areas of our Site may be limited.

One of the third-party services the Site uses is Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to analyze how individuals use the Site. The information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google on servers in the United States. Safeguarding Your Information

We maintain administrative, technical and physical safeguards reasonably designed to protect the personal information you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. Notwithstanding these security safeguards, it is impossible to guarantee 100% security in all circumstances.

How We Retain Personal information

We retain your personal information for as long as reasonably necessary to fulfill the business purposes and to comply with legal, regulatory or record retention obligations that we describe in this Privacy Policy, unless a longer retention period is required or permitted by law. Any request to delete your personal information is subject to these obligations and restrictions. Note that deletion may involve aggregation, deidentification, or anonymization of data, in accordance with applicable data protection laws.

Your Choices

We may offer you certain choices about how we communicate with you and what information we collect from you. To update your preferences, ask us to remove your information from our email or call marketing lists or submit a request related to our communications with you, please contact us as indicated in the How To Contact Us section of this Privacy Policy.

Please note that if you ask to be removed from a contact list, we may still contact your regarding specific services or transactions we are performing on your behalf.

Children’s Personal information

Our Site is designed for a general audience and is not directed to children. We do not knowingly collect or solicit personal information for children under the age of thirteen (13) through our Site. If we become aware that we have collected personal information from a child under thirteen (13), we will promptly delete the information from our records. Updates To Our Privacy Policy

This Privacy Policy will be updated periodically to reflect changes in our personal information practices. We will provide you notice of any changes to this Privacy Policy as required by law, and we will indicate at the top of this Privacy Policy when it was most recently updated. California state privacy rights addendum

This California State Privacy Rights Addendum (“Addendum”) supplements Boston National Title Agency, LLC and its affiliates (the “Company”) Privacy Policy and applies solely to the personal information we collect for California consumers. This Statement does not apply to information collected, processed, sold, or disclosed pursuant to the Gramm-Leach-Bliley Act and its implementing regulations or the California Financial Information Privacy Act.  In addition, this Statement does not apply to personal information the Company processes as a service provider to another entity.

This Addendum is intended to address the relevant notice requirements of the California Consumer Privacy Act and its implementing regulations (the “CCPA”). Certain terms used herein have the meaning given to them in the CCPA. Nothing in this Addendum is intended to contradict or limit the applicability of the information provided in our Privacy Policy or the Privacy Notice you received if you are a customer of the Company for closing services or title insurance.

Notice of Collection and Use of Personal information

We may collect the following categories of personal information about you:

  • Identifiers: identifiers such as a real name, postal address, unique personal identifier (such as a device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology); telephone number, online identifier, internet protocol address, email address, Social Security number, and other similar identifiers
  • Additional Data Subject to Cal. Civ. Code § 1798.80: signature, physical characteristics or description, state identification card number, insurance policy number, education, bank account number, credit card number, debit card number, and other financial information, medical information, and health insurance information
  • Protected Classifications: characteristics of protected classifications under California or federal law, such as race, color, national origin, religion, age, sex, gender, gender identity, gender expression, sexual orientation, marital status, medical condition, ancestry, genetic information, disability, citizenship status, and military and veteran status
  • Commercial Information: commercial information, including records of personal property, products or services purchased, obtained, or considered, and other purchasing or consuming histories or tendencies

  • Employment Information: professional or employment-related information

We may use your personal information for the purposes described in our Privacy Policy. In addition, we may use your personal information for certain business purposes specified in the CCPA and its implementing regulations, including as described below:

  • Performing Services: Performing services on behalf of the business, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the business
  • Auditing: Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards
  • Short Term Use: Short-term, transient use, including, but not limited to, nonpersonalized advertising shown as part of a consumer’s current interaction with the business, provided that the consumer’s personal information is not disclosed to another third party and is not used to build a profile about the consumer or otherwise alter the consumer’s experience outside the current interaction with the business
  • Security Purposes: Helping to ensure security and integrity to the extent the use of the consumer’s personal information is reasonably necessary and proportionate for these purposes.
  • Marketing: Providing marketing services, except for cross-context behavioral advertising, to the consumer provided that, for the purpose of advertising and marketing, a service provider or contractor shall not combine the personal information of opted-out consumers that the service provider or contractor receives from, or on behalf of, the business with personal information that the service provider or contractor receives from, or on behalf of, another person or persons or collects from its own interaction with consumers
  • Debugging: Debugging to identify and repair errors that impair existing intended functionality
  • Undertaking Internal Research: Undertaking internal research for technological development and demonstration
  • Undertaking Other Activities: Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us.

Our Prior Collection, Use and Disclosure of Personal information

We may have collected and used your personal information, as described in section 2 above, during the 12-month period prior to the effective date of this Addendum. For the personal information collected during that timeframe, we describe below information regarding our disclosure of personal information with third parties.

  • Limit the Use of My Sensitive Personal information: Sensitive personal information may include the following: social security number, driver’s license, state identification card, or passport number, account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, or union membership; the contents of a mail, email, and text messages, genetic data, biometric data, health information, and information concerning sex life or sexual orientation. We have not used or disclosed sensitive personal information outside of the exemptions allowed for in the CCPA and its implementing regulations.

Shine the Light Request. Subject to certain limitations under California Civil Code § 1798.83, you may have the right to request that we provide you with (a) a list of certain categories of personal information we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year and (b) the identity of those third parties.  To submit a Shine the Light request, please contact us or call 877.569.6547.

Authorized Agents. To submit a request as an authorized agent on behalf of a consumerplease contact us or call 877.569.6547. If you use an authorized agent, we may request a copy of the agent’s signed permission to act, verify your identity directly, and ask that you confirm the agent’s authority.

Verifying Requests. To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your request. In addition, if you ask us to provide you with specific pieces of personal information, we will require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.
